Terms of Use

1. Eligibility

You must be legally able to enter into a binding agreement in your jurisdiction to use the app. You are responsible for ensuring that your use of the app is lawful where you live.

2. Description of the App

Degen Check is a Solana-focused mobile app that allows users to:

• connect a compatible Solana wallet;
• sign a wallet message to verify control of a wallet;
• check recent on-chain wallet activity;
• draft and share experience posts through X/Twitter; and
• track in-app progress and XP locally on the device.

The app is provided for informational and entertainment purposes. It is not a broker, exchange, custodian, money transmitter, investment adviser, financial planner, tax adviser, or legal adviser.

3. No Financial, Legal, or Tax Advice

Nothing in the app constitutes financial, investment, legal, tax, accounting, or regulatory advice. You are solely responsible for evaluating any wallet activity, digital asset activity, transactions, and related risks.

4. Wallets and Third-Party Services

The app relies on third-party wallets, blockchain infrastructure, and external services, including Solana network infrastructure and X/Twitter sharing links. We do not own or control those third-party services and are not responsible for their availability, security, privacy practices, or performance.

Your relationship with any third-party wallet or service is governed by that third party's terms and policies.

5. User Responsibilities

You agree that you will not:

• use the app in violation of any applicable law or regulation;
• use the app to engage in fraud, deception, market manipulation, or other unlawful conduct;
• upload, post, transmit, or promote content that is illegal, infringing, hateful, violent, sexually explicit, deceptive, malicious, or otherwise harmful;
• misrepresent your identity, affiliations, or ownership of a wallet;
• attempt to interfere with, exploit, disable, reverse engineer, or compromise the app, user devices, wallets, or related services;
• use the app to distribute malware, phishing content, or links to untrusted or harmful destinations; or
• use the app to violate the terms of any third-party service.

6. User-Generated Content and Sharing

If you create, draft, submit, or share any content through or in connection with the app, including text intended for X/Twitter:

• you are solely responsible for that content;
• you represent that you have the rights necessary to create and share it;
• you must not submit content that violates law, third-party rights, or these Terms; and
• you understand that once content is shared through a third-party platform, it may be publicly visible and governed by that platform's rules.

7. Privacy

Your use of the app is also subject to the Degen Check Privacy Policy.

8. Intellectual Property

The app, including its branding, software, layout, and original content, is owned by or licensed to the Publisher and is protected by applicable intellectual property laws. These Terms do not grant you ownership of the app or any intellectual property rights except the limited right to use the app for its intended purpose.

9. Availability and Changes

We may modify, suspend, restrict, or discontinue any part of the app at any time, with or without notice. We may also update these Terms from time to time. Continued use after updated Terms are made available means you accept the revised Terms.

10. Disclaimers

The app is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

We do not guarantee that:

• wallet connections or signatures will always succeed;
• blockchain data will always be accurate, current, or complete;
• third-party services will remain available; or
• the app will be error-free, secure, or uninterrupted.

11. Limitation of Liability

To the maximum extent permitted by law, the Publisher will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, digital assets, or business opportunities arising from or related to your use of the app.

To the maximum extent permitted by law, the total liability of the Publisher for all claims arising out of or relating to the app or these Terms will not exceed the greater of: the amount you paid, if any, to use the app in the 12 months before the event giving rise to the claim; or USD 50.

12. Indemnity

You agree to defend, indemnify, and hold harmless the Publisher from and against claims, liabilities, damages, losses, and expenses arising out of or related to: your use or misuse of the app; your violation of these Terms; your violation of any law or third-party right; or any content you create, submit, or share.

13. Termination

We may suspend or terminate your access to the app if we reasonably believe you violated these Terms, applicable law, or platform requirements.

You may stop using the app at any time. Because the app currently stores most data locally on your device, uninstalling the app and clearing local app data will generally remove locally stored app records on that device.

14. Governing Law

These Terms are governed by the laws of Argentina, without regard to conflict of law principles, except to the extent otherwise required by mandatory consumer protection law.
